1. e-community solutions s.r.o. is the operator of a shared community electromobility service under the Peoplecar trademark, through which vehicles owned by the municipality or other cooperating entity can be used, and these vehicles can be used both by employees or members of municipal authorities for work purposes, as well as by other customers (hereinafter referred to as the “Service”).
2. The Service is provided on the basis of the General Terms and Conditions (hereinafter referred to as “GTC”).
3. During the provision of the Service and in connection with its provision, personal and other data of customers (hereinafter referred to as “Data”) are collected through so-called distance communication (websites, applications and other technical means) — hereinafter also “Web Resources”. The owner and operator of the Web resources is e-community solutions s.r.o., with its registered office at Varšavská 715/36, Vinohrady, 120 00 Prague 2, Czech Republic, ID: 19488106, registered in the Commercial Register under file number C 387400 kept at the Municipal Court in Prague. 4. The controller of the collected Data is Peoplecar.
5. Peoplecar pays careful attention to the protection of personal data of users of the Service. The collected Data is used only for the purposes of administration, operation and marketing of the Service.
6. Peoplecar reserves the right to change this privacy policy. Peoplecar will inform you in advance of any material changes.

Collection of data

In accordance with established practice, we collect and retain the following information (stored in web server log files):

1. the public IP address of the computer from which the request was received (this may be the user's computer directly),
2. name of the client station - identification, if possible, carried out via http protocol,
3. the name of the user specified during the authorization process,
4. the time when the request was made,
5. the first line of the http request,
6. http response code,
7. URL of the website last visited by the user - if the website www.peoplecar.eu was entered via link,
8. information about the user's browser,
9. information about errors that occurred during the execution of http transactions. In order to ensure the highest quality of pages, we occasionally analyze log files to determine which websites are visited most often, which browser is used, whether the web page structure contains errors, etc.

Registration on the website in the application

In order to provide the Services, the User is required to register via the Peoplecar mobile application. The registration form can be accessed by clicking on the “Register” button. The data provided during registration is necessary for the provision of services.

Registration process:

1. the creation of a new account involves the provision of registration data: “email and password”,
2. in the next step, the user confirms the registration by receiving an e-mail verifying this e-mail address and clicking on the link that was sent to the address indicated in the “e-mail” box,
3. system, date and time of registration,
4. after confirming registration and logging in to his account, the user provides the following information:
   (a) name and surname,
   (b) date of birth;
   (c) the address of permanent residence,
   (d) telephone number,
   (e) where applicable, the information necessary to confirm the payment method:
   — debit/credit card number,
   - the validity of the debit/credit card,
   — CVV debit/credit card code.
5. In addition, the user provides a scan/photo of his driver's license, identity card and his face together with the identity card in order to verify the users' permission to drive the vehicle. The reading of the documents is carried out manually, then the following personal data are recognized: name, surname, date of birth, date of validity of the document and the group of driving privileges, and are stored in the Peoplecar system.

Use of the Services

When you register and use the Services, we collect and process location data. For example, to ensure the correct pick-up and return functionality of the vehicle at the appropriate parking space, you need to collect and record information about the physical location of your mobile device. We also collect location data directly from vehicles when the service user uses the vehicle.

When you request customer service, support or other assistance, you may choose to provide us with your contact information so that we can better respond to your requests, and we may retain information about your dealings with our support services.

If the user of the Service is an employee or a member of the municipal authority who will use the vehicle for work purposes, data on this fact and his job classification/function within the municipality is further collected.

Use of Data

The data is used for the purpose of providing the Services (including vehicle monitoring, including when using them), communicating with Users regarding their accounts, transactions and notifications related to the Services, operating the website and fulfilling Peoplecar's legal obligations, including, but not limited to, fulfilling obligations to the tax authorities under Directive DAC7 (Council Directive (EU) 2021/514) and for the provision of marketing or advertising services by Peoplecar.

Statistics may be generated from the information and data provided in order to assist the administration and operation of the Website and the Service. Reports in the form of such statistics will not contain any characteristics identifying the person visiting the website.

Cookies

Cookies are not used to collect any personal data of website users. For each web page www.peoplecar.eu We use the following cookies:

• _ga - files associated with Google Universal Analytics. They are used to recognize unique users by assigning a randomly generated number as a user identifier. Information regarding the processing of personal data of vehicle users by Peoplecar

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter “GDPR”), we would like to provide you with the following information regarding the processing of your personal data:

I. Controller of Personal Data and Data Protection Officer

The controller of your personal data is e-community solutions s.r.o., with its registered office in Varšavská 715/36, Vinohrady, 120 00 Praha 2, Czech Republic, ID: 19488106.

This controller has appointed a Data Protection Officer (DPO), who can be contacted regarding all matters related to the processing of personal data. Contact details: dpo@peoplecar.eu.

II. Purpose and reasons for data processing

The controller processes your personal data with the following purpose:

1.  compliance with the requisites and conditions of the vehicle rental agreement concluded between the vehicle owner and the user (Art. 6 (1) (b) GDPR);
2.  fulfilment of legal obligations imposed by the controller (Art. 6 para. 1 (c) GDPR) relating, inter alia, to the performance of the contract, the issuance of tax documents;
3.  for the purposes of the legitimate interests of the controller (Art. 6 para. 1 lit. f) GDPR), including: resolving and protecting against possible claims in connection with the application of legal regulations or concluded contracts, for internal administration purposes;
4.  sending, via text message or e-mail, information and marketing materials about the services provided by the Administrator and the cooperating entities, including anonymous questionnaires used to collect demographic and profile data, based on the consent provided by the user (Art. 6 (1) (a) GDPR).

III. Recipients of data

The recipients of your personal data are the persons providing the Services, i.e. Peoplecar, municipalities or entities that are owners and operators of shared vehicles, and other entities providing services to administrators under relevant contracts in the following areas: IT and other administrative and support business services, law, consulting, insurance and payment service providers, marketing agencies, analytical and statistical companies, gateways for text messages and e-mail, as well as entities entitled to collect your personal data on the basis of relevant legal regulations, e.g. courts and state authorities.

IV. Data retention period

Your personal data will be stored for as long as necessary to fulfil the reasons for which they are processed and then for the time necessary to protect against seeking to assert any claims or defences against them and to fulfil any obligations arising from the law.

After deleting the user's account, his/her personal data will be stored for the purpose of applying a fine in connection with the rides made by the user.

The retention period for which personal data is necessary for us, i.e. for the purposes of rights and obligations under our contractual relationship, is 3 years from the date of the last trip. This period may be extended by 2 years if legal or other proceedings are initiated during this period.

The data collected for marketing purposes is deleted within two weeks after the deletion of the user's account, but not later than 5 years.

Due to the fact that it is not possible to create a user account again under the same email address, after deleting the account, it will be kept in an encrypted form, which represents the legitimate interest of the administrator.

V. Rights of natural persons

Based on the provisions and conditions specified in the Data Protection Regulations, you have the right to:

1.  request information from us about what personal data are being processed,
2.  request access to personal data from us and have them updated or corrected, or request restriction of processing,
3.  request the erasure of personal data from us — except for data processed for the purposes of the contract;
4.  on the portability of data to another entity (at your request, we will transfer your personal data registered with us to a third party designated by you), request a copy of the personal data processed,
5.  to lodge an objection with us regarding the processing of personal data that we will deal with,
6.  lodge a complaint with the Office for Personal Data Protection with the registered office of Pplk. Sochora 27, Prague 7, 170 00 (https://www.uoou.cz), for judicial protection if you consider that your rights have been violated as a result of processing your personal data in violation of the law.

VI. Transfer of data to third countries or international organisations and profiling information

There is no such transfer of data.
